Heard a rumour that due to lack of board members the Trust is no more - judging by the lack of reply to posts seems true.

I don't think it -can- just fold.

The Trust is a legal entity in its own right, which means it can only be dissolved either in accordance with its rules, or by means of the usual process for winding up of such bodies in the case of insolvency.

To be dissolved would require either the consent of three quarters of the membership, or action by the Financial Services Authority, either of which would no doubt involve some sort of formal notice to members being served - likewise, if the Trust was insolvent there would be procedures to follow before it could be wound up. It can't just cease to be.

Perhaps they have just gone into hiding then, as they are showing a total lack of respect towards it members, only 3 people left on the board now I think. They have just walked away and washed their hands of the Trust. Who is going to enforce these rules no-one me thinks.

I thought the Trust had been washed, ironed, pressed & placed in the bottom draw for many weeks. The total lack of any response to any of the questions asked on this Board, I feel backs up this statement.

Just one futher question, will the Members be receiving a refund on their subscriptions or will it be used to sponser the Annual Beer Festival which is always a great success, very profitable & will be soon upon us.

Every Thing Forward & Trust In The Lord.

Reply from Supporters Direct - So can I have a response:
Supporters’ Trusts are not the property of the board concerned and are not permitted to simply dissolve; even in circumstances where the organisation is moribund (that is where it has failed over some time to function in all but name) the minimum required is for an advert to be placed calling for anyone interested to come forward to take on the organisation, otherwise be dissolved. This clearly does not apply in the case of Notts County Trust as it has a membership that will have to be notified of any proposal from the board or indeed membership to wind the organisation up.

However I am well aware that there have been a great deal of difficulties in forming a new board following the events of last year and don’t know whether they have begun considering any such proposal themselves. I’d certainly encourage you to contact one of the remaining board members to see if there’s anything you can do to assist.

I also e-mailed Supporters Direct to complain at the shameful way the members are being ignored by the people voted in to represent us. I asked if they could put any pressure on our 'leaders' to respond to the many unanswered questions. Here is the reply:

Hi,

Could I ask you specifically what it is you are asking of the current board so I can determine whether or not there is anything Supporters Direct can do? We are permitted to intervene in problems at supporters’ trusts, and have done so before – not least at Notts – however as they are sovereign organisations we are not able to do so except under certain circumstances.



Whilst I do take your concerns seriously, as far as the directors are concerned I am aware that there are only two serving directors of the Trust as we speak, with a Secretary (who is not formally a part of the board), John Collin, who has made it clear that he wishes to step away when a replacement can be found. The board being depleted to the extent it is suggests to me that their ability to function is severely impaired, which I suspect is the reason they’re not responding in the manner that you have the right to expect under normal circumstances. As you will doubtless know, all this follows an election where there were only a handful of candidates standing to fill a board the majority of which were standing down.



As I would do with any member of any organisation, particularly in the current circumstances, I would also encourage you to consider perhaps becoming involved, as ultimately the organisation lives and dies by its members. Indeed it is also important for the membership to decide where it wants the organisation to go in the future, and indeed whether or not it actually wants an organisation of this type.

A further update fron Supporters Direct:

I have spoken to Glenn Rolley about the current situation at the Notts Trust, and also about the issues you’ve raised.



As you’ll know, the elections in October saw only three candidates for 6 places, and the subsequent resignation of David Peck before Christmas has left only Glenn and Margaret Cobb on the Board and John Collin as Secretary remaining. This has left the organisation, as you’ll appreciate, down to its bare bones – indeed it isn’t even current quorate and therefore able to operate normally in respect of the rules. I am also aware that there have been other serious personal issues for at least one remaining Board member to deal with, reducing even further their ability to not just operate the organisation but to respond to queries from members.


Glenn tells me that they will be shortly be sending out a members’ email which he hopes will address some of the concerns about the future of the organisation. He is also looking to provide as much detail as possible as a response to other queries about the surrender of shares to Munto last summer.



Please email Glenn on glenn.rolley@ntlworld.com if you do have any specific issues you wish him to address in the meantime.

In effect the Trust is no more. The last communication from the Trust stated this

"The chair, Glenn Rolley, gave a full and frank account of the last year, which was on occasions brutal in the detail delivered. Special focus was given to the way the Trust and Club were almost destroyed by actions of a few. Tributes were given to John Collin and Nigel King for their true professionalism in the face of such iniquity. The Chair went on to outline the gratitude ALL Notts fans owe to John Armstrong Homes in delivering the Munto investment for our football club."

Given recent events, it is understandable why nobody would want to volunteer to serve on a Board that can put out propaganda such as this. This Trust is forever tainted by the actions of a few and they aren't the few named in the paragraph above. The only hope would be to disband and start again. The sad thing is that our club could be in administration within weeks and this Trust has turned away all the supporters who might have the will to save the club.

So two weeks after Kevin Rye of Supporters Direct tells us we will shortly be receiving an email from the Trust Board - NOTHING!

Anybody else find it ironic that Kevin Rye is the "Communications Manager" for SD.

After all what is the rush we still have a whole seven days before the Club is wound up!

Stll nothing heard, also are the board getting perks of sitting in the directors box? I seem to remember when I was on the board and a member of the supporter's club coach committee gave me a free Torquay away ticket, I had to pay the money back and was told off for accepting it, although I never signed any sort of agreement, so I hope you are paying for the privilege and as a defunct board why are you still assuming the role and ignoring its members.

It would appear they are a Law unto them selfs Jurgen.
